Terms and Conditions of use of the ElDorado.aero Website and the El Dorado application

The user of ElDorado.aero expressly accepts the Terms and Conditions of Use of this website and the Personal Data Processing Policy of SOCIEDAD CONCESIONARIA OPERADORA AEROPORTUARIA INTERNACIONAL S.A. – OPAIN S.A. (hereinafter OPAIN) available for public consultation at https://www.opain.co/files/membretepoliticastratamientodatos.pdf

The content of this web page is the property of OPAIN, therefore its total or partial reproduction, translation, inclusion, duplication, sale, negotiation, distribution, transmission, transformation, storage or access through analog, digital or of any other system or technology created or to be created, without the prior written authorization of OPAIN.

The ElDorado.aero website may not be used for immoral or illegal purposes, its consultation and use must be carried out in accordance with the Applicable Laws.

The content of ElDorado.aero is governed by the Applicable Laws of Colombia. All published brands and logos are the property of OPAIN or third parties that have authorized their inclusion and use. Its use is prohibited without prior express and written authorization of the corresponding owner.

OPAIN S.A. disclaims any liability for damages that may arise from viruses or other harmful elements in the content.

ElDorado.aero could contain links to sites operated and maintained by third parties, for which OPAIN S.A. does not exercise control over such sites, their products, information or services. Each user is obliged to read the terms and conditions of the internet sites linked through the ElDorado.aero website and decide whether or not to accept them.

To make use of some of the services of the Website, it is necessary to provide personal data and the treatment thereof. Said activity will be governed by the Privacy Policy and the Data Treatment Policy In any case, the User will not provide information that: (i) is fraudulent, false, misleading (directly or by omission or failure to update the information) or misleading ; (ii) is not owned by you; or (iii) violates any OPAIN policy.

The “El Dorado” application (hereinafter “the application” or “El Dorado”), which belongs to OPAIN, has as its main objective the recognition of passengers and officials who use the services of the El Dorado International Airport of Bogotá (hereinafter forward the "Airport") and it does so through the digital registration in this application. It also allows the creation of a digital entry pass to the airport (“Dorado Pass”). . The application collects information in order to allow users to generate a digital identity document. All content created by or for the "El Dorado" application conforms to the guidelines mentioned in this document.

The general conditions of use of the application are the following:

• The users of the application may be classified as follows:

• Passengers

• Airport Employees

• Companies with branches at the Airport

• The biometric information will be used so that the processes within the airport do not require the delivery of documents, but through a QR code or facial recognition, access to the different control points within the airport is allowed.

• Likewise, this information will be used so that within the airport the passenger can carry out all his processes without having to present passports, IDs or boarding passes (where possible). This protocol is aligned with the industry standard promoted by IATA to have a temporary Token ID and for the passenger to have a smooth travel experience within the Airport.

• All biographical and biometric information can be deleted at any time at the request of the passenger or official through the email habeasdataoficial@eldorado.aero

• Biographical and biometric information will be kept solely by OPAIN under the highest levels of security, its contractors may have access to it for purposes of biometric validation.

• The biographical and biometric information recorded in the enrollment process, the passenger authorizes the OPAIN airlines and contractors that develop and maintain said tool to access the digital identity created in said process and allow the OPAIN airlines and contractors that develop and maintain said tool to associate the boarding passes to that identity and in this way create a unique Token ID per trip, thus allowing to guarantee that the facial recognition process works within the airport facilities in the different processes of check-in, delivery of suitcases, income to filters and boarding, among others.

1. Acceptance of Terms.

When a user accesses the "El Dorado" application, he does so under its responsibility. Access to and/or use of the application and its tools is completely voluntary and attributes the condition of User to whoever does it, for this reason, the use of the application means the ACCEPTANCE AND KNOWLEDGE, without limitation of any kind, of the terms and conditions that are indicated in the following paragraphs, and the breach of said terms and conditions will give rise to the legal actions that proceed.

OPAIN reserves the right to carry out at any time, unilaterally and without prior notice, modifications or updates to these Terms and Conditions, for the attention of legislative or jurisprudential news, internal policies, new requirements for the provision or offering of our services or products.

2. Intellectual Property.

The application and its content, including texts, logos, graphics, videos, animations and sounds, are the property of their authors, including OPAIN, thus they reserve all intellectual property rights on the contents of their authorship and on which they be ceded All contents are protected by national and international intellectual property regulations.

Their total or partial reproduction, translation, inclusion, transmission, storage or access to them by any means, without the prior written authorization of OPAIN, is prohibited.

In relation to the contents of the application, the user agrees to:

Use the contents diligently, lawfully and correctly.

Do not delete or manipulate the copyright and the data that identifies the rights of OPAIN

Do not use the contents of the application to broadcast advertising.

The user will not incur in and from the application, in illegal conduct such as computer attacks, interception of communications, copyright infringements, identity theft, among others. Nor will it attack the application in any way, against its technological platform or interfere with its technological operation.

The visitor of the application will be responsible for the improper or illegal use of the same and its contents.

3. Use of the Platform.

In order to make use of the services offered by the "El Dorado" application, the user must be of legal age and have the legal capacity to contract obligations. To this extent, OPAIN will not be responsible to the user or to third parties, for controversies or damages that derive from the lack of veracity of the information provided by the user. In the event that the user is a minor, the information must be provided by the adult who has their legal representation or who has been in charge of their custody.

To make use of the services of the application it is necessary to provide personal data and the treatment thereof. Said activity will be governed by the Privacy Policy and the Data Treatment Policy. In any case, the User will not provide information that: (i) is fraudulent, false, misleading (directly or by omission or failure to update the information) or fallacious; (ii) is not owned by you; or (iii) violates any OPAIN policy.

4. Consumption relationship, Means of Payment, Billing and Reimbursements.

OPAIN will make a digital platform available to third parties so that through it, the products are offered and the corresponding sales are made. The consumer relationship derived from the acquisition of products and/or services offered on said platform through the "El Dorado" application will be governed by the regulations contained in Law 1480 of 2011 - Consumer Protection Statute.

The payment of the services and products offered on the website that are made through the Internet, will be made through platforms that guarantee the security of transactions. It is important to clarify that the services provided by these payment platforms are subcontracted, which is why OPAIN is not responsible for failures, errors, fraud or any type of inconvenience that may be generated against the means of payment or the payment itself made. through the aforementioned platforms. For this reason, OPAIN recommends that users review the Terms and Conditions of said payment platforms before making any transaction through them.

In relation to claims, OPAIN clarifies that any request seeking reimbursement or return of money must be made through the channels enabled by OPAIN for Petitions, Complaints and Claims. It is necessary to clarify that the presentation of the request does NOT guarantee a positive response to the claim, nor the effective return of the money. The claim may be submitted through the following channels:

Physical mailboxes within the facilities of the El Dorado International Airport.

It must be accompanied by all the documentation that the claimant wishes to assert.

OPAIN will be in charge of transferring the claims to whoever corresponds, and these in turn will be in charge of giving the corresponding answers.

5. Privacy and data processing

This Privacy Policy describes all aspects related to the information we collect when you use the “El Dorado” application or when you register on the ElDorado.aero website. Please read this Privacy Policy before providing any personal information or giving your consent to authorize the processing of your Personal Data. By authorizing the processing of your personal data, you accept the practices described in this Privacy Policy and accept that OPAIN processes your personal data. 

If you do not agree with these practices, you have the right to discontinue use of the application at any time.

OPAIN considers as a fundamental objective to guarantee and protect the privacy and confidentiality of the personal data of its users, in accordance with current legislation.

The user can freely navigate the application; however, when registering in the same application by entering personal information, the user voluntarily decides whether to perform the process or not.

As a company, OPAIN is committed to safeguarding the privacy of the user's personal information obtained through the application, for which it establishes a data treatment policy as explained below.

OPAIN notifies users that it has adopted technical and organizational measures that guarantee the security of personal data and prevent its alteration, loss, treatment or unauthorized access. In this way, OPAIN undertakes to comply with the duty of secrecy and confidentiality with respect to the personal data contained in the databases, as well as to grant them safe treatment in the assignments and international transfers of data that, where appropriate, may occur.

The information is collected directly from the owner of the personal data, who provides it voluntarily and authorizes the treatment thereof. The information must be complete and truthful, for this reason, the user is responsible for the data provided; OPAIN is not responsible for their veracity.

OPAIN reserves the right to disclose your personal information to comply with legal requirements, enforce our Terms and Conditions and Privacy Policy, and Personal Data Processing, respond to complaints that have to do with the rights of third parties, protect the rights of any person, their property or safety or in general, to ensure the adequate provision of the service and compliance with the Law. This information will be disclosed under the corresponding laws, regulations and procedures.

Notwithstanding the foregoing, we note that in accordance with the law the rights of the owner of personal data are the following: a) Know, update and rectify your personal data before those responsible for Treatment or Treatment Managers. This right may be exercised, among others, against partial, inaccurate, incomplete, fractioned, misleading data, or those whose Treatment is expressly prohibited or has not been authorized; b) Request proof of the authorization granted to the Treatment Manager except when expressly excepted as a requirement for Treatment in accordance with the provisions of article 10 of Law 1581 of 2012; c)Be informed by the Treatment Manager or the Treatment Manager, upon request, regarding the use that has been given to your personal data; d) Submit complaints to the Superintendence of Industry and Commerce for violations of the provisions of this law and other regulations that modify, add or complement it; e) Revoke the authorization and/or request the deletion of the data when the Treatment does not respect the constitutional and legal principles, rights and guarantees. The revocation and/or deletion will proceed when the Superintendence of Industry and Commerce has determined that in the Treatment the person in charge or in charge has incurred in conduct contrary to this law and the Constitution; f) Free access to your personal data that have been processed. e) revoke and/or request the deletion of the data when the Treatment does not respect the constitutional and legal principles, rights and guarantees.

Opain also reserves the right to make modifications or updates to this privacy notice at any time, to attend to new legislation or jurisprudence, internal policies, new requirements for the provision or offering of our services or products.

6. Indemnity and Release of Liability.

The User agrees to hold harmless and respond to OPAIN for any claim, demand, loss, liability and expense (including attorneys' fees) arising from: (i) your use of the application to access the Services and/or products offered ; (ii) your breach or violation of any of these Terms; (iii) OPAIN's use of your personal information; or (iv) your violation of the rights of any third party.

In the same way, the User agrees to exempt, defend (according to OPAIN's criteria), indemnify and release OPAIN and its affiliates and subsidiaries from liability, as well as their managers, directors, employees and agents, against and against any claim, responsibility, compensation for damages, losses and expenses, including, without limitation, the reasonable expenses of legal and accounting advice, that arise from, or are in any way related to: (i) the breach by the User of the these Terms, (ii) the User's misuse of the Platform, the website or any Service, or (iii) the violation by you of any laws, regulations or rights of third parties.

If you use the application, the User will do so voluntarily and at his own risk.

7. Responsibility for the information contained.

Since it is not possible to ensure the lack of interference by third parties in technological applications, OPAIN does not guarantee the accuracy or veracity of all or part of the information contained in the application. It will not respond if the information has been altered or modified in whole or in part after it was published. OPAIN does not control the presence of viruses and other computer elements in the contents that may cause alterations in the Users' equipment and/or in their electronic documents.

The user acknowledges that it is not technically possible to achieve 100% availability of the El Dorado application Service. Especially for reasons of maintenance, security or capacity, as well as due to events that OPAIN cannot influence. However, OPAIN will endeavor to keep the Service available as constantly as possible.

8. Applicable Law.

These conditions constitute a legally binding contract between OPAIN and the user of the application. All relationships arising from the conditions or from this contract will be governed by the laws of the Republic of Colombia, in aspects that are not expressly regulated therein. If any provision of these conditions loses validity or binding force, for any reason, the other provisions retain their binding force and will generate all their effects.

9. Validity of the Terms and Conditions.

These terms and conditions developed by OPAIN come into force on 24 of May of 2023.
